osivibecode ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial purposes and in accordance with this EULA.
The App is intended for users aged 13 and over. By using the App you represent that you are at least 13 years old, or that you have reached the age of digital consent in your jurisdiction, whichever is higher.
You may not:
Elektronik 198x is an original work inspired by the electronic handheld games of the 1980s. It is not affiliated with, endorsed by, or licensed by any manufacturer of such devices, and no third-party artwork, sound, or trademark is reproduced in it. Names of historical devices, where mentioned, are used descriptively only.
Your scores and, if you join the global leaderboard, the display name you choose ("Your Content") belong to you. Local scores are stored on your device; we have no access to them. Leaderboard entries are stored on our servers as described in the Privacy Policy. You are solely responsible for Your Content and for maintaining your own copies of anything you cannot afford to lose.
Joining the global leaderboard is optional. If you join, you agree that:
You may stop posting scores, or delete your leaderboard data and account entirely, from within the App at any time. Deleting releases your name, and it may then be claimed by another player.
The leaderboard is open to every player. A subscription does not buy a place on it, or any advantage in the scores posted to it.
The App, including all features, code, graphics, logos, and design, is the exclusive property of osivibecode and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any rights to trademarks or service marks of osivibecode.
The App integrates third-party services:
Your use of these third-party services within the App is governed by their respective terms and privacy policies. osivibecode is not responsible for third-party services or content.
The App is supported by advertising. By using the App you acknowledge that advertisements will be displayed, and that ad content is supplied by third-party networks and is not selected, endorsed, or controlled by osivibecode. Optional rewarded advertisements may grant an in-game benefit; declining one never prevents you from playing.
An active Elektronik PRO subscription removes the third-party advertising described above. The App may still promote other applications published by osivibecode; these in-app suggestions are our own and remain on every plan, PRO included.
The App offers an optional paid subscription, Elektronik PRO ("PRO"). Buying it is never required: the App is fully playable without it.
The exact feature list, the plans available to you, and the price of every billing phase are shown in the App before you buy, on the screen that takes the purchase. Where the two differ, the price shown by your app store at the moment of purchase governs.
PRO is offered as one or more auto-renewing plans, typically monthly and yearly. Prices are set per country and shown in your local currency by the app store; they are not set by, or paid to, osivibecode directly. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
The subscription renews automatically. Unless it is cancelled at least 24 hours before the end of the current period, it renews for another period of the same length, and your account is charged for renewal within 24 hours before the end of the current period.
Where a free trial or a discounted introductory period is offered, eligibility is determined by the app store, not by us, and each offer may be used once per store account. Unless you cancel at least 24 hours before it ends, a free trial converts automatically into a paid subscription at the price shown. If you buy a subscription during a free trial, any unused portion of that trial is forfeited.
You can manage or cancel your subscription at any time in your app store account settings â on iOS under Settings â your name â Subscriptions, and on Android in the Google Play Store under Payments & subscriptions. Cancelling stops the next renewal; PRO stays active until the end of the period you have already paid for. Deleting the App does not cancel a subscription.
All purchases are handled by Apple or Google. Refunds are therefore governed by the policy of the store you bought from, and requests must be made to that store â osivibecode cannot issue, reverse, or guarantee a refund. Except where required by law, payments are non-refundable, and a partly used period is not refunded on cancellation.
A subscription belongs to the app store account that bought it and can be restored on any device signed in to that account, using "Restore purchase" in the App's settings. It cannot be shared between different store accounts except through the store's own family sharing, where the store makes that available.
We may change the price of a plan, or change, add to, or withdraw the features included in PRO. A price change never applies to a period already paid for, and takes effect on renewal only after the store has given you the notice and, where required, obtained the consent that its own rules demand. If we withdraw PRO entirely, you may cancel; your current period runs to its end.
The App's alarm is scheduled locally by your device's operating system. Delivery is not guaranteed â battery optimisation, power saving modes, forced stops, device restarts, permission changes, and OS scheduling policies can all delay or prevent a notification. The App must not be relied upon where a missed alarm could cause harm or loss, including medical, legal, financial, or safety-critical matters.
osivibecode is solely responsible for any maintenance and support for the App. Apple Inc. and Google LLC have no obligation whatsoever to furnish maintenance or support services for it. Support requests go to the contact address in section 20; support is provided on a best-effort basis and no response time is guaranteed.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
osivibecode does not warrant that:
In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Nothing in this section limits any right you have under the consumer law of your country that cannot be waived by agreement.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, osivibecode SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL osivibecode'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID FOR THE APP AND ITS SUBSCRIPTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $0 IF YOU PAID NOTHING IN THAT PERIOD).
Your use of the App is also governed by our Privacy Policy, which is incorporated into this EULA by reference. By using the App, you consent to the data practices described in the Privacy Policy.
osivibecode may release updates, patches, or new versions of the App at any time. Such updates may be required for continued use. We reserve the right to modify or discontinue the App (or any part of it) at any time without notice, subject to section 10.8 for subscribers.
We may also update this EULA from time to time. The updated EULA will be posted at this URL with a new effective date. Continued use of the App after changes constitutes acceptance of the revised EULA.
This license is effective until terminated. Your rights under this EULA will terminate automatically and without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies. We may also terminate your access to the global leaderboard, and delete the data associated with it, for a breach of section 6. Termination for breach does not entitle you to a refund of any subscription period.
This EULA shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts located within the United States. This does not deprive you of the protection of the mandatory consumer law of your country of residence.
